Jail officials in dock over Amit Shah’s release

The central bureau of investigation (CBI) is believed to be preparing a strong case against Shah for cancellation of his bail when the Supreme Court hears the case next on November 15.

The Sabarmati jail authorities could find themselves in trouble for releasing former minister of state for home, Amit Shah, late in the night, in violation of the rules of the jail manual. The central bureau of investigation (CBI) is believed to be preparing a strong case against Shah for cancellation of his bail when the Supreme Court hears the case next on November 15.

The probe agency is likely to raise questions about the haste shown by the Sabarmati jail authorities in releasing Shah after the Gujarat high court granted him bail in the Sohrabuddin Sheikh fake encounter case. Sources close to the CBI said the probe agency is going to file an affidavit before the Supreme Court and it will also argue that the jail authorities had released Shah against the rules because of the influence he wields in the state.

The sources further said that the CBI may also highlight how the former minister was provided the air-conditioned chamber which is meant for the jail superintendent. "The probe agency may also draw attention to the fact there were no restrictions regarding visitors who come to jail to meet Shah," a source said.
Amit Shah was granted bail on October 28 and, in violation of the jail manual rules, he was released from Sabarmati jail at around 10 in the night. He then went directly to his home in the city where he addressed a public meeting.

According to the rules, prisoners are not released from jail after evening. They can only be released during daytime because all prisoners have to return to their barracks before sunset for the counting of prisoners. Another source said that the probe agency wasn't able to mention these facts in the petition it filed before the Supreme Court seeking cancellation of Shah's bail, as it had drafted it before Shah was released from prison. "But now the CBI will narrate the whole incident to show how influential Shah is in the Gujarat," the source said.

The source further said that Sabarmati jail authorities will have to explain why Shah was released in violation of the jail manual if the Supreme Court gives importance to their lapse during the hearing.
Shah was released on bail three months after his arrest on July 25 in the Sohrabuddin Sheikh fake encounter case. He had filed for bail before the Gujarat high court after the CBI special judge rejected his plea for bail. The former minister is accused of involvement in the conspiracy to kill Sohrabuddin, Kausarbi and Tulsi Prajapati.
