IPS officer Sharma’s case heard by CAT principal bench

Kuldeep Sharma alleged that Gujarat government was not giving him due promotion though he is eligible to hold the post, by showing a biased attitude.

The delay in the hearing of the case filed by senior IPS officer Kuldeep Sharma had prompted him to apply to the principal bench of the Central Administrative Tribunal (CAT) in Delhi. The case was heard on Wednesday and the orders for the same are awaited by Sharma.

Sharma filed a case in CAT claiming that he was not promoted to Director General of Police (DGP) because of 'biased approach' by Gujarat government. In the application, Sharma alleged that the state government was not giving him due promotion though he is eligible to hold the post, by showing a biased attitude.

Rather, he was appointed as the MD of the Sheep and Wool Development Corporation -- which is quite an unsuitable post for an IPS officer and which, besides, is an administrative position.
Talking to DNA, a source close to the development said that Sharma's case has not been heard by the CAT bench in Ahmedabad for many months. The tribunal had already issued a notice to the state government to clarify its stand on this.

"A member of the bench is a Gujarat cadre officer and knows Sharma very well, so he refused to hear his case," the source said. The source also said that the case was delayed because of this and so Sharma had gone to the principal bench and had requested that his case to be heard by it.

"The case was heard by the principal bench before the chairman of CAT and the orders are expected in a day or two," the source added. Sharma was the additional director general of police (ADGP) of the Gujarat police who was sidelined and posted as MD Gujarat State Sheep and Wool Development Corporation.

He had mentioned in the application that he is ready to serve in the central government on deputation and the central home secretary had also communicated with the state government in the matter.
However, the state government is avoiding his deputation.

He further said, he has been serving in the Gujarat cadre for a long time and his performance has been evaluated as 'outstanding' in his Annual Confidential Report (ACR). Therefore, he is eligible and suitable to get promotion.
