High court appoints two-member team to prepare report in Banda rape case

The Allahabad high court today authorised a two-member delegation, comprising a woman lawyer and a rights activist, to assist the court by meeting the victim in the infamous Banda rape case and submit a report of its findings.

The Allahabad high court today authorised a two-member delegation, comprising a woman lawyer and a rights activist, to "assist the court" by meeting the victim in the infamous Banda rape case and submit a report of its findings.

A division bench of Justice Imtiyaz Murtaza and Justice SC Agarwal nominated Vandana Mishra, general secretary of UP chapter of civil rights organisation PUCL, and advocate Deeba Siddique "to meet the girl and prepare report accordingly for submission to this court" on January 21.

The order was passed on an application of Ravi Kiran Jain, senior advocate and national vice-president of PUCL, who had argued that the PUCL be impleaded as one of the petitioners in the case and its volunteers should be permitted to assist the court".

Earlier, on January 15, the specially-constituted division bench had taken suo motu cognisance of the rape victim being booked for theft charges after she had accused BSP MLA Purushottam Naresh Dwivedi of having sexually assaulted her.

The court had ordered immediate release of the vicitm and directed police officials to provide adequate security to the 17-year-old girl and her family members.

Meanwhile, the court also expressed displeasure over "delay of about five hours" in communicating the January 15 order to the district administration and asked its registrar general to submit a report about the same.

Taking note of the suspension of the in-charge of the police station concerned, the court observed that the state government's counsel had "assured the court that he would intimate the court about the action taken by the government against senior officers of the district administration in the matter".
