Consumer court orders insurance company to pay Rs5.5 lakh as
compensation.
After fighting a legal battle for more than a decade, Nilesh Patel of Krishna Industries heaved a huge sigh of relief when he was awarded compensation for the damages he had incurred when his truck, carrying edible oil, had met with an accident near the outskirts of Ahmedabad.
GA Ahuja and Bharat Joshi of State Consumer Redressal Forum had ordered the National Insurance Company to pay compensation of Rs5.5 lakh with an interest rate of 8% per annum from November 1999 till date to Patel.
As per case details, on November 5, 1999 Patel’s truck carrying edible oil was on its way from Krishna Industries in Jetpur to Swapra Hygiene Food Pvt Ltd at Sarkhej.
When the truck reached the outskirts of city, it met with an accident with the driver and cleaner of the truck severely injured. In the accident Krishna Industries suffered huge losses worth more than Rs5.68lakh from the loss in 11,455kg of edible oil.
As the truck was under insurance cover with National Insurance Company, Patel approached the insurance company for getting compensation. Moreover, a case was also filed in this connection with the concerned police station and the roadways authority also issued certificate for the damages. In due time, Patel also approached the insurance officer, Arun Arora of National Insurance Company. However, Arora allegedly demanded bribe from Patel to clear his compensation file.
Later, Patel approached State Consumer Redressal Forum to seek justice. “The Consumer court ordered compensation to be paid as the insurance company didn’t file any affidavit in the case and had also not examined any witness in the case,” said advocate Kishor M Paul, who had appeared on behalf of Krishna Industries.
