Gujarat HC orders action against magistrate

Justice MR Shah of the Gujarat high court has ordered to take action against a magistrate posted at Ahmedabad (rural) court for not following proper legal procedure in a case related to cheating of an NRI.

The high court was annoyed with the conduct of the magistrate while hearing the case filed by an NRI, who had been duped by some persons by taking possession of his bungalow on the basis of a bogus power of attorney.

“This court is pained to note the conduct of the 4th joint JMFC, Ahmedabad (rural). The conduct … of the learned magistrate is to be considered on administrative side,” said justice Shah, directing the magistrate to start procedure afresh, and quashing earlier process in the case.  Thereafter, the magistrate concerned was transferred, and is at present posted at Ahmedabad (rural).
