Girish Dani threatened with defamation case over notice

Pravin Patel has slapped a legal notice on Girish Dani, secretary of Karnavati Club, for an allegedly misleading notice in newspapers.

Patel has also threatened to file a defamation case against Dani. In the notice published in newspapers on July 11, Dani had said that Patel's advocate IH Syed had knowledge about LPA 449 of 2005, with regard to construction of Golden Glory Hall on government land, being disposed by Gujarat high court.

The notice said despite this, Syed argued before the Supreme Court that the said appeal was pending, so SC directed the Gujarat high court to take a final decision in the said appeal.

However, Patel's advocate said that Gujarat high court had disposed LPA 449 of 2005 but Patel had challenged the HC's order by filling a special leave petition and the said petition is pending in the Supreme Court. Patel also alleged that by publishing such notice, Dani tried to interfere with the administration of justice. He said Dani failed to publish a fair and accurate report of the judicial proceedings in the SC thus maliciously trying to interfere with the course of justice in the pending proceedings before both the high court and the Supreme Court.

The notice slapped on Dani alleges that the facts mentioned in the public notice were not the same as those mentioned in the order of the Supreme Court passed in SLP 12362 of 2008 on July 9, 2010. Patel has asked Dani to reply to the notice within two weeks or else he will proceed to file a contempt petition against him.
