Framing of charges against Sanjiv Bhatt deferred

The Gujarat High Court on Friday granted relief to IPS officer Sanjiv Bhatt in a 20-year-old case and ordered a trial court in Jamnagar to defer the framing of charges against the suspended IPS officer by two days. Framing of charges in the case of alleged police atrocity in which one person died, was scheduled for September 27. The court also scheduled the next hearing in the case on September 27. Counsels appearing for the state government, Bhatt and other parties have been asked to complete their arguments on that day.

On Friday, the order asking the Jamnagar court to defer framing of charges by two days was passed by Justice RH Shukla of the high court. During the hearing in court, there were heated arguments between Bhatt's advocate, IH Syed, government pleader Prakash Jani and Percy Kevina, counsel for the complainant whose brother had died in the incident.

Bhatt has contended in his petition that the withdrawal of the revision application 15 years after it was filed was intended to harass him. The IPS officer has further alleged that as he had accused Gujarat chief minister Narendra Modi of having played a dubious role in the 2002 communal violence, the government had decided to withdraw its revision application opposing prosecution of Bhatt and the others in the case.

As per the case, in 1990, when Bhatt was posted in Jamnagar as DySP, a person died allegedly due to police brutality during a communal flare-up in Jamkhambhliya taluka. A local court initiated criminal proceedings against him and six others in this regard.

The state government had earlier filed a petition seeking revision of the lower court's order but, recently, after Bhatt's allegations against the CM in connection with 2002 riots, it had withdrawn the revision petition.
