‘Duped’ man gets refund from bank

He was charged arrears for a free health policy provided by pvt bank.

The Gujarat State Consumer Disputes Redressal Commission (GSCDRC) on Saturday dismissed an appeal against order of Ahmedabad City Forum holding ICICI Lombard General Insurance Limited, Mumbai and ICICI Bank liable for deficiency in service. This development comes after a complaint was filed in the matter by Consumer Education and Research Society (CERS), Ahmedabad and Deepak Khatwani, a customer of the bank.

The Forum, by its award dated December 30 last year, had directed ICICI Lombard General Insurance Ltd to credit Rs19,049.08 into Khatwani's savings bank account within two months from date of order. The insurance company was also supposed to pay him 7% interest on the amount from the date of its debit from his savings bank account. The company shall also refund him Rs2,210 which were illegally recovered from him, with 7% interest attached from date of recovery until payment.
According to case in the matter, ICICI Bank, Ahmedabad in February 2005 had issued a credit card to Khatwani which he used occasionally, made regular payments, and had no complaints upto February 2007.

On February 16, 2007, Khatwani was informed via telephone, that he being "a valuable ICICI credit card holder", ICICI Lombard General Insurance Ltd was offering him a healthcare policy free of cost for two years through the bank, after which it would be chargeable. He accepted the offer and received a health policy from Health cops ICICI Lombard General Insurance. A sum of Rs3 lakh was insured dating from February 22, 2007 to February 21, 2008.

However, contrary to terms of the offer, Khatwani received an ICICI Credit Card statement dated May 21, 2007 from ICICI Bank Ltd showing total amount due as Rs2,728.55.
