Dinakaran decision after Dussehra

Karnataka high court chief justice PD Dinakaran is set for a tense Dussehra break. Whether the controversial judge will be elevated to the Supreme Court (SC) or not will be decided by five senior judges of the apex court (collegium) soon after the festival on September 28.

The collegium headed by Chief Justice of India (CJI) KG Balakrishnan and comprising justices BN Agarwal, HS Kapadia, Tarun Chatterjee and Altamas Kabir had summoned Dinakaran on September 11 and asked him to explain a series of allegations levelled against him by the Committee on Judicial Accountability (Coja) and the Tamil Nadu Forum for Judicial Accountability (Foja) in memoranda submitted to prime minister Manmohan Singh.

He denied the allegations of land-grabbing and amassing agriculture land flouting regulations in home state Tamil Nadu.

But, sources said, the prime minister does not want to leave anything to chance and has referred the letter signed by eminent lawyers such as Fali S Nariman, Ram Jethmalani and Shanti Bhushan, among others, to law minister M Veerappa Moily. This after the constitutional experts drew his attention to the collegium’s September 8 decision to elevate Dinakaran to SC.

Moily is likely to meet them on Friday. Amidst the uproar over the controversial appointment, two associations of high court and SC lawyers have asked the government to amend the Constitution and establish a national commission for judicial appointments.

“We also request the minister (Moily) to disclose names of judges recommended for appointment to various high courts or the Supreme Court. This will ensure transparency and nip in the bud the chances of appointment of persons of doubtful integrity,” the bar associations said.

Nariman asserted that there was an urgent need for a thorough probe into the allegations against Dinakaran, who has been quoted in the media as saying, “I am wealthy. Therefore, I don’t need to be corrupt’’.

Nariman said elevating a suspect judge to SC was bad and his appointment as a (high court) judge in the first place, worse.
