Delhi high court suspends NDMC decision to levy parking fee in Khan Market

The Delhi high court today temporarily suspended the NDMC's decision to charge money for parking vehicles at Khan Market, an upscale south Delhi area.

Justice S Muralidhar suspended the New Delhi Municipal Council's decision, which was to be implemented from the next week as per an instruction of Environment Pollution Control Authority (EPCA), on a plea Khan market traders.

Justice Murlidhar stayed the civic body's decision till May 18, the next date of hearing of the traders' plea, in an interim order, saying "status quo to be maintained till the next date of hearing."

The court also issued a notice to the NDMC and the Centre through the ministry of environment and forest and sought their replies within four weeks.

Appearing for the NDMC, counsel Madhu Tewatia submitted to the court that the civic agency has been following the instructions of the ministry of environment and forest. This prompted the court to make the ministry a a party in the case.

The court had yesterday posted the matter for today while directing the counsel for the NDMC to seek instructions from the department over the issue.

Filing a petition through counsel Sanjiv Sachdeva, the Khan Market traders' association had said "the NDMC's decision is discriminatory as there are various areas in the NDMC zones where free parking is still permitted."

"The market complex is visited by high-profile clientele comprising diplomats, politicians, judges, high government officials and as a result the market is under constant scrutiny with regard to the facility and amenities available in the market," the traders had said and sought quashing of the NDMC's decision.

According to them, the paid parking would encourage parking mafias.
