Delhi high court asks MCD to pay Rs50,000 to man for demolition of PCO

The Delhi high court has asked the MCD to pay Rs50,000 as compensation for demolishing a PCO booth owned by a physically challenged man in Delhi University for beautification of the area ahead of the Commonwealth Games.
 
Justice Rajiv Sahai Endlaw directed the civic agency to pay the amount to Satish Manchanda within four weeks failing which it would incur an interest of 12% per annum.
 
"From the photographs filed in the case, it is clear that the property of Manchanda has been damaged. The alleged contemnor MCD would in any case be liable to compensate him for the same," justice Endlaw said.
 
According to Manchanda, he had spent Rs1.5 lakh on construction of the PCO structure. Due to the MCD action, the belongings in the shop were also lost besides loss in income which is estimated to be more than Rs50,000.
 
He claimed that he had been running the PCO for past several years and the MCD demolished his kiosk despite a stay order from this very court.
 
The court was hearing a bunch of petitions filed by a group of vendors including Manchanda challenging MCD's move to demolish the kiosks allotted to some physically challenged persons on Tehbazari (vending rights) in the University area.
 
Meanwhile, the court granted 15 days time to owners of 16 such kiosks, which were used either for running PCO or tea stalls, to vacate the premises.
 
The court, however, restrained MCD from taking any coercive action or allotting the land to any new party till its further order.
 
"The respondent MCD is restrained from allowing any other kiosk vendors, hawkers in the University area. If there is any proposal, the petitioners would be given the first right for the same," said the court.
 
Countering the averments of the vendors, the MCD counsel submitted that about 250 kiosks have been asked to shift from the area and the owners were allotted alternative places in Gandhi Vihar locality.
