Court reserves order on Sanjiv Bhatt’s plea

A court in Jamnagar district will decide on December 9 whether or not to frame charges against suspended IPS officer Sanjiv Bhatt and 6 other policemen in connection with a 21-year-old murder case.

On Wednesday, Bhatt was present in the court and he moved a petition requesting the court to hear his revision application challenging the proceedings initiated against him by the magisterial court long back. The judge, NT Solanki, heard the public prosecutor as well as Sanjiv Bhatt’s lawyer and reserved his order till December 9.

“Sanjiv Bhatt and the other six accused policemen have moved an application requesting that framing of charges against them be postponed as they have filed a revision application against the lower court’s proceedings,” said Vimal Chotai, the public prosecutor (PP) appearing in the case.

“We have opposed their plea as they have filed it many years after the magisterial court ordered that they be tried in the case. Moreover, neither the Gujarat high court nor the Supreme court has granted him relief,” he said.

“Further, such a plea should not be heard as many years have passed since the order of the magisterial court,” Chotai added.
However, IH Saiyad, counsel for Bhatt and the other accused, said they had filed a petition before the court as the Supreme Court had given them liberty to do so and also mention errors in the order of the high court.

“The court heard the arguments and adjourned the case till December 9,” he added.

The case relates to the death of one Prabhudas Vaishnani who had allegedly died of serious injuries sustained on the night of October 30, 1990 at a police station where he was thrashed by the police.

According to the original complaint, the police had thrashed Prabhudas and others on the orders of Bhatt who was then assistant superintendent of police (ASP), Jamnagar. The court is to frame charges against the accused policemen in connection with the alleged offense as the government has withdrawn its petition that protected them from court’s proceedings in the matter.
