Aarushi case: CBI's hurry to file closure report questioned

A special court on Monday dismissed the plea by Aarushi Talwar's parents not to close the double murder case saying it was 'not maintainable' at this stage but asked the CBI what was the 'hurry' in filing the closure report.

The suspense over the fate of the CBI’s closure report in the Aarushi Talwar murder case is set to linger. A special court hearing the matter questioned the agency as to why it was in a hurry to close the case. It also dismissed the plea by the slain girl’s parents not to close the double murder case, saying it was “not maintainable” at this stage. The case will come up for hearing on January 7.

“What was the hurry (in filing a closure report)? Where are the documents (annexures) of the closure report?” the court asked the CBI. The agency’s counsel AK Saini informed the court that the agency files such a report under due process after a decision is taken.

The Ghaziabad court has asked the agency to submit all the relevant documents, including the case diary, during the next hearing. It also issued a notice to Aarushi’s dentist parents Rajesh Talwar and Nupur Talwar, who remain suspects in the sensational case.

The Talwars’, in their application, stated “it’s a heinous case” and in the “interest of justice” should not be closed. The CBI had on December 29 filed a report to end the probe in the murder case of Aarushi and Hemraj clearing the names of three servants — Raj Kumar, Krishna and Vijay Mandal. But the needle of suspicion pointed towards the father — Rajesh Talwar— whom the agency named as a suspect who could not be chargesheeted because of “insufficient evidence”.

Meanwhile, the counsel for three servants has said that an application would be filed soon seeking compensation from the agency and the government. “We will seek compensation for the trauma that Krishna, Raj Kumar and Vijay Mandal underwent. CBI always knew who the culprits were but still arrested the three,” lawyer Naresh Yadav said. “We will also ask the court to prosecute those who had arrested the three innocent persons.” — With PTI inputs
