Court rejects plea of Naroda riot accused

The court of SH Vora, hearing the Naroda gaam case, has rejected the application submitted by accused in the case, demanding the SIT to submit the investigation report. The accused in their application have stated that there is no need to cross examine them if the SIT has completed its investigation.

Judge Vora, while rejecting the application, stated that if the applicants want SIT to submit the investigation report they should approach the Supreme Court because only the apex body has the authority to take decision in the matter. In fact, the SIT has already submitted the monthly report on its proceedings to the apex court. The court also rejected the application on grounds that it does not hold any merit as there is no provision to stop the trail while the investigation is on. Earlier, the accused in the case had filed an application before the court stating that when the incident occurred, those belonging to the minority community also attacked people of the majority community, but no case was registered against them. 

In their application, the accused stated that if the SIT is through with the investigation then there is no need to cross examine them. Both the defense counsel and the public prosecutors argued in this connection. Public Prosecutor Nigam Shukla pleaded that SIT has been constituted by the Supreme Court, and it has authorised the body to conduct investigation even after a chargesheet is filed in the case.
