Court asks NRI fugitive wanted in US to file case laws

A Delhi court asked an NRI fugitive, wanted in the US for allegedly killing his estranged wife, to file case laws in support of his plea.

A Delhi court today asked an NRI fugitive, wanted in the US for allegedly killing his estranged wife, to file case laws in support of his plea that he cannot be extradited as the US failed to give an assurance that he will not be send to the gallows.

Additional chief metropolitan magistrate AK Pandey asked VK Ohri, counsel for fugitive criminal Avtar Singh Grewal, to submit citations/case laws in support of his plea.

The court fixed the matter on November 13 for further arguments in the case.
 
Grewal had earlier filed an application contending the External Affairs Ministry's plea to extradite him be dismissed as an assurance has not been given by the US authorities that death penalty, if imposed on him, would not be executed.

The extradition plea be not allowed as a mandatory assurance was not given by the USA that death penalty would not be executed if a court there awards it, the application had said.

Grewal, 33, was arrested by CBI on arrival at the IGI Airport here on March 31, 2007, following a look-out circular issued against him by the Interpol at the request of the Indian federal investigation agency.
 
Grewal, then working as manager with a firm at Vancouver in Canada, had travelled to Phoenix in the US and flew out of that country after allegedly killing his wife on March 29, the extradition request said.
