Not satisfied with the punishment given to the magistrate booked for corruption charges, the office of public prosecution has given opinion to the law department to file an appeal in the case seeking enhancement of judicial magistrate’s punishment. The prosecution has also suggested that the relatives who were acquitted should also be punished.

In the opinion for challenging the order convicting Premji Gohil, the judicial magistrate for corruption charges, the office of public prosecution has stated that the law department should move and appeal before the Gujarat High Court for enhancement of the punishment of Gohil to set an example in the society.

Advocate HG Majumdar, the public prosecutor, has stated that Gohil was entrusted with the job of giving justice and punishing the culprits and by setting an example of honesty in society. However, Gohil had on the other hand violated the provisions of prevention of Corruption Act with the help of his relatives.

In the opinion, Majumdar has also suggested that the court has erred while acquitting the relatives of Gohil. He stated that there is ample evidence against them and they should have been convicted.

Hence, he opined that in this case the law department should file an appeal challenging the order of the sessions judge.

The special sessions court, Ahmedabad (Rural) on Monday convicted Gohil for the charges of illegal gratification and misappropriation of assets. The former judicial magistrate, Pardi, Valsad, Premji Gohil was convicted under the Prevention of Corruption Act and was sentenced to two years rigorous imprisonment.

However, the court had acquitted his wife and brother-in-law, giving them the benefit of the doubt.
