‘BDA rejected CM’s plea on site’

The Bangalore Development Authority (BDA) had rejected chief minister DV Sadananda Gowda’s request in 2009 for the amalgamation of the site he owned in HSR Layout with the adjacent site, the high court was informed on Wednesday.

 The case, in which the petitioner sought action against Gowda for an alleged illegal construction in HSR Layout, was adjourned by a week after the state government sought time to file its objections.
Journalist KG Nagalakshmi Bai, in her petition, had alleged that Gowda violated the law by constructing buildings without proper approvals. She questioned the legality of a 50x80ft site in HSR Layout in which Gowda constructed a five-storey building.

In its statement of objections, BDA said the chief minister had sought the amalgamation of his site by filing an application on June 4, 2009. The application was rejected on September 24, 2009. “The issue of licence approval of the plans as per the zoning regulations of RMP-2015 and building by-laws and the issue of completion certificate are within the jurisdiction of the BBMP while they have no role to play in this,” BDA said.

The division bench headed by Justice DV Shylendra Kumar adjourned the case by one week after the state government sought time to file objections.
