AP police seeks Maoist leader Kobad Ghandy's custody

A local court here will deliver orders on Wednesday on the petition filed by Andhra Pradesh police seeking the custody of senior Maoist leader Kobad Ghandy arrested from Delhi.

After hearing the arguments and counter arguments, Karimnagar additional judicial first class magistrate S Srivani, posted Kobad Ghandy's case for tomorrow for orders.

The prosecution contended,"It is for the police to question Ghandy regarding the plans of the Maoist group and also to investigate on the weapon dumps, arms and explosives and land mines planted by the Maoists."

The prosecution argued that Ghandy be given in state police's custody as he is the Maoist Central Committee leader.

While opposing the custody, the defence counsel said the police cannot seek Ghandy's custody under Section 267 of the Criminal Procedure Code, as no charge and accusation has  been made against their client.

"There is no prima facie material or evidence put forth before the court for asking Ghandy's police custody," the defence counsel said.

Ghandy was arrested on September 20 by the special cell of Delhi police.
