Justice RH Shukla of the Gujarat high court adjourned hearing of the bail application moved by former MoS home Amit Shah in the Sohrabuddin Sheikh fake encounter case to October 26.

Senior counsel Ram Jethmalani appeared on behalf of Amit Shah while senior counsel KTS Tulsi argued for the CBI.

Shah has appealed against the lower court order, denying him bail earlier this month.

Jethmalani reiterated that the investigating agency has been acting as a tool of the Congress-led UPA government in the Centre, and harassing Shah despite the fact that there is no significant evidence against him.

Jethmalani, in an affidavit filed in the court, claimed that Sohrabuddin was a dreaded gangster, and his client has nothing to do with his encounter.

The affidavit further stated that builder brothers, Raman and Dashrath Patel, who are prime witnesses in the case, are accused of firing in their own office. He said Shah's name did not figure in the video recording done by the Patel brothers. Even Sohrabuddin's brothers and a prime witness Azam Khan have also not named Shah, the affidavit claimed.

Jethmalani said there is no possibility of Shah intimidating witnesses in the case as he never tried to interfere even when he was enjoying powers as the MoS home. He urged the court to grant bail to Shah.

Shah had filed the affidavit in reply to the affidavit filed by the CBI on Wednesday.

On the other hand, CBI claimed that Shah is making determined efforts to derail the investigation and legal process.
