Amarinder case: HC directs dispatch of records to trial courts

The FIRs were recorded at Mohali, Patiala and Ludhiana pertaining to alleged acts of corruption among others by Amarinder, Virk and former minister Jagjit Singh Chaudhary.

On a petition filed by the government, the Punjab and Haryana high court today directed to dispatch records pertaining to cases of corruption against former chief minister Amarinder Singh and others, to trial courts.

A division bench also allowed lower courts to continue proceedings against Amarinder, former Punjab and Maharashtra police chief SS Virk and others.

The court agreed with the submissions made by Punjab government that summoning of the records tantamount to stay on the proceedings which was forbidden by the Supreme Court in the cases under the Prevention of Corruption Act.

The bench of chief justice Mukul Mudgil and Justice Jasbir Singh said trial courts are not restrained from proceeding further notwithstanding the pendency of the present petition which would be taken up on April 20, 2010.

On a PIL, a former Punjab law commission member and two others had contended that the vigilance bureau had been working as an "oppressive outfit" aiming at settling personal or political scores without following relevant guidelines.

After preliminary hearing on the PIL on November 30, 2009, another division bench of the court had summoned the records of the government and the trial courts with regard to to four FIRs registered by the vigilance bureau against the accused.

Today, the bench directed the government to prepare photo-stat copies of the records of the cases which are the subject matter of a petition and file the certified copies of the same along with an affidavit.
