‘Active’ phone found in Nalini Murugan's cell

According to sources, this could hamper Nalini’s chances of premature release.

An active mobile phone has been seized from Nalini Murugan, who is serving a life sentence in the Rajiv Gandhi assassination case, the Tamil Nadu police said on Tuesday.

“Vellore women special prison superintendent Rajalakshmi and her team seized an active mobile phone from Nalini during a routine check on Tuesday morning. We are probing the matter and appropriate action will be taken under the Prisons Act,” director-general of prisons and additional director-general of police KR Shyamsundar told DNA.

The police and prison authorities were not ready to discuss the issue further.

According to sources, this could hamper Nalini’s chances of premature release.

Nalini, through her lawyer M Radhakrishnan, had filed a writ petition in the Madras high court challenging the recommendations of the prison advisory board based on which the Tamil Nadu government had rejected her plea for premature release.

Though the hearing on the admissibility of the petition had been listed in the court of justice N Paul Vasantha Kumar, it still has not come up for hearing.

Kumar asked Radhakrishnan to submit a copy of the judgment by a two-member bench that had rejected her writ plea.

Nalini has been seeking premature release since 2006 under the Tamil Nadu Prisons Act and section 433A of the criminal procedure code, which allow a life convict to seek release after 14 years in jail.

Nalini also sought premature release under an amnesty scheme wherein life term convicts are released at the discretion of state governments on national festivals (Independence Day, Republic Day or Gandhi Jayanti) for good conduct.

The TN government refused to take a decision on her plea, claiming her case was probed by the Central Bureau of Investigation.

A two-member bench of the Madras high court early this month dismissed her petition after the government stated its stand based on the board’s recommendations. Nalini has been in jail since June 1991.
