Abhay Chudasama seeks bail for hip surgery

Abhay Chudasama who was arrested by the Central Bureau of Investigation (CBI) last month in connection with the Sohrabuddin Sheikh fake encounter case, has filed a temporary bail application before the session court, seeking his release on medical grounds.

Chudasama who had filed the application through his advocate Rohit Verma had pleaded that he had to undergo a major hip replacement surgery on his left leg and needed three months time for operation.

Through his application, Chudasama stated that he had met with an accident in the year 1994. In the year 2000, on account of continuous regression, he had to undergo a hip replacement surgery on his right leg.

However, since December 2008 there has been a continuous pain in his left leg and he has been facing problems in walking, sitting as well as sleeping. The session judge would be hearing the case on May 31.

Earlier, three other accused in the case, NH Dabhi (PI), Himanshu Singh

Rajavat (PSI) and Shyam Singh Charan (PSI), had also filed a default bail application at the court of additional chief metropolitan magistrate VB Barot. The three have been languishing in Sabarmati central jail for the last three years.

The three have filed their applications through their advocate Rohit Verma with a plea that after the CBI was handed over the investigation by the apex court, it had registered the case on February 1, 2010 and the copy of the FIR had been forwarded to the CBI court on February 4.

The statutory period of 90 days for submitting report under section 173(2) has expired on 5.5.2010. Even after the passing of 90 days the central agency has not submitted the charge-sheet against the accused in the case and so they should be granted default bail. 

Metropolitan magistrate, VB Barot had posted the hearing on June 1 for the application.
