Janata Party president Subramanian Swamy Saturday named Tamil Nadu chief minister and DMK chief M Karunanidhi as a co-accused along with former communications minister A Raja in the 2G spectrum scam in his complaint to a CBI court here.

“I have named DMK chief Karunanidhi as a co-accused along with Raja in the matter and many more names will be added,” Swamy told the CBI court.

The court asked the CBI, which is presently interrogating Raja, former telecom secretary Siddartha Behura and Raja’s former personal secretary R K Chandolia, to file a detailed report of the investigation being carried out by it and whether it covers the aspect of national security as raised by Swamy in the present case.

Comptroller and Auditor General Vinod Rai, who was earlier summoned by the court to appear as a witness on Swamy’s complaint, filed a certified copy of the entire report concerning the matter through his advocate Sandeep Sethi.

The Special CBI judge had on January 22 sought the presence of Rai and CAG official R P Singh in the court today to depose as witnesses on the complaint by Swamy, seeking registration of a criminal case against Raja for his alleged role in the scam, which, according to the CAG, caused a presumptive loss of Rs1.76 lakh crore to the exchequer.

The CBI, however, has only accused the DMK leader of causing a loss of Rs22,000 crore to the exchequer by favouring some telecom firms in award of the 2G spectrum licences.

During the hearing, the special judge today said, “I am of the opinion that this court should not proceed for the time being with this matter.”

Swamy, however, defended his complaint and said that the at the the two cases can be clubbed and tried together at a later stage.

The court had on January 7 held as “maintainable” the private complaint filed by Swamy on December 15 last year.

Swamy had pleaded that his complaint be taken cognizance of and Raja be summoned to take the case to its logical conclusion. He also requested the court to appoint him “as a deemed public prosecutor under the provisions of the Prevention of Corruption Act.”

Swamy also wanted the court to direct agencies like the CBI and the Enforcement Directorate (ED) to assist him in conducting the prosecution, and further investigation of the scam.
