2G scam: Karim Morani joins A Raja and Kanimozhi in Tihar

Cineyug Films director Karim Morani on Monday joined former telecom minister A Raja and Rajya Sabha MP Kanimozhi in Tihar jail for his alleged involvement in the 2G spectrum allocation scam.

A special CBI court on Monday dismissed Morani’s bail application, saying the allegations against the accused are of very serious nature and there is evidence to support them.
Morani has been accused by the CBI of facilitating kickbacks to the tune of Rs200 crore to Kalaignar TV. Kanimozhi, who has been named co-conspirator in the case, is a shareholder in Kalaignar TV. The Delhi high court on Monday also reserved its judgment on the bail pleas of Kanimozhi and Kalaignar TV chief Sharad Kumar. The duo was arrested on May 20.

Accusing Morani of trying to delay the judicial process, CBI judge OP Saini said: “The accused used every possible legal subterfuge to delay the ultimate (outcome) as he filed seven applications within a span of less than one month.”
  
“An accused is entitled to avail all legal remedies available, but the sheer number of applications filed by him reflects adversely on his conduct. It indicates that he is interested in deliberately delaying the disposal of the matter by seeking date after date, on one pretext or the other,” Saini said.

Morani had been seeking exemption from court appearances citing medical reasons. The Bollywood biggie wore a brace neck during his court appearance on Monday. His lawyers said he underwent angioplasty and had been in hospital for many days. However, the court said despite his medical reports stating that his condition was stable, Morani evaded court appearances from May 6 to May 23.
“Considering the magnitude of the crime, nature and enormity of allegations, character of evidence on record and the apprehension that witnesses may be influenced in case the accused is released on bail, I have no hesitation in holding that the accused (Morani) has failed to make a case for bail,” Saini said. “I sincerely hope, considering the nature of the case, he would improve in future and would cooperate in the early disposal of the case.”

Morani, who was accompanied by his wife and two daughters, broke down after the verdict. His family later issued a press release saying, “The family is completely shattered by the way his medical condition was ignored in case of his anticipatory bail application. Bail is not a gift from those who yield temporary power. It is a right. The law must take its course; a sick man should be given the right to protect his health and justice will prevail.”
