2G scam: A Raja misled prime minister, says CBI

The CBI has found that Raja had written two letters to the prime minister Manmohan Singh in November and December 2007 on this first-come-first-served policy issue.

The CBI probe against A Raja has revealed that the former telecom minister allegedly “misled the prime minister” and “misrepresented” facts fraudulently to justify his decision of changing the cut-off dates for Unified Access Service (USA) licences.

The CBI has found that Raja had written two letters to the prime minister Manmohan Singh in November and December 2007 on this first-come-first-served policy issue.

The first letter was written on November 2 and the second on December 26. After examining both the letters CBI found Raja had “intentionally” and “deliberately” distorted facts in an attempt to mislead the prime minister.

The CBI chargesheet says, “...Raja on November 2, 2007, wrote a letter to the PM, misrepresenting facts and fraudulently justifying his decision regarding the cut-off date of September 25, 2007. He maintained that it was the actual cut-off date and an order in this regard had already appeared in the newspapers...”

“...However, the actual cut-off date for receipt of application was October 1, 2007. But it was Raja’s sudden decision, taken on September 24 in which cut-off date was advanced. He also misled the PM by stating that law ministry’s opinion that the matter should be referred to the empowered group of ministers, was out of context.”

The chargesheet says A Raja was already in a criminal conspiracy with accused Unitech MD Sanjay Chandra, and DB realty and Swan Telecom promoters Shahid Balwa and Vinod Goenka, before the publication of the cut-off date in newspapers.

“Raja knowingly misrepresented the facts and misled the PM while mentioning that the department was not deviating from the existing procedure,” the CBI chargesheet has noted.

The CBI has also claimed Raja was familiar with Shahid Balwa, Vinod Goenka and Sanjay Chandra during his tenure with environment and forest ministry in UPA-I when he had reportedly granted clearances to real estate projects of their companies.
