1984 riot: Counsel writes letter to CP on shifting of trial

A lawyer, representing the victims in the 1984 riots case, has written a letter to Delhi Police Commissioner requesting him to verify the authenticity of alleged threats to Congress leader Sajjan Kumar before shifting his trial from a court here to the Tihar jail.

In a letter to BK Gupta, senior advocate HS Phoolka has suggested that police should consult other agencies like Intelligence Bureau and Intelligence Wing of Punjab Police before taking any decision in this regard.

He told the police to make sure that the alleged threats are not "self-generated reports by Sajjan Kumar to attract public attention and gain sympathy".

Phoolka said he and victims have no objection to shifting of the case to Tihar Jail premises if it involves the security of Karkardooma Courts Complex where the trial is going on.

"However I would like to request you to kindly verify the reports of the threat. It may not be a self-generated reports by Sajjan Kumar to attract public attention and gain sympathy," he said.

He also referred to a recent letter written by the Delhi Police to the District and Sessions Judge for shifting Sajjan Kumar's trial from Karkardooma court complex to the Tihar Jail on security grounds.

"I have learnt that the Delhi Police has written to district-cum-sessions judge for shifting of the trial of Sajjan Kumar from Karkardooma Courts to Tihar Jail premises on the ground of security threat," he said.

He said many officers of the Delhi Police have allegedly favoured Sajjan Kumar referring to 2010 judgement of the Delhi High Court where it had criticised police for filing closure report and giving clean chit to Sajjan Kumar despite the fact that the case had been transferred to the CBI.

The senior counsel also said that final judgement in the case involving Sajjan Kumar is likely to be delivered within two months.
