18-year-old gang rape victim asks Gujarat high court to transfer her case

The petition states that the trial in the case is already started and the girl is under pressure by the accused to make a compromise in the trial.

The 18-year-old girl who is a victim of gang rape registered with the Limdi police station, has moved the Gujarat high court seeking transfer of the trial to another district as she has been pressurised by the accused.

The court has on Thursday issued notices against all the accused who are lodged in jail at present.

The girl has in her petition stated that she had been suffering from rape trauma syndrome and was being treated in several hospitals. She has alleged that she is under constant pressure and threat from the accused’s family.

The petition states that the trial in the case is already started and the girl is under pressure by the accused to make a compromise in the trial.

As per the prosecution case registered with the Limdi police station on January 17, 2010, Meena (name changed to protect identity of the victim) was gangraped. As per the case, Meena was who was in standard 12, along with her friend Reema (name changed as the accused is minor) had gone to meet Meena’s sister from Limdi at Joravar nagar. However, on the way Reema took her to a place where Reema’s father and cousins were present.

They made her drink liquor and shot video clippings of her. Then, all the accused raped her and she subsequently lost consciousness. The accused left her near the mill compound area from where she was later taken by her parents.

The petition alleged that after the incident she was not mentally stable. She was under the treatment of a gynaecologist and a psychiatrist as she had lot of internal and external bodily injuries and was suffering from rape trauma syndrome. Further, her father has also been influenced by the accused and has abandoned the girl and her mother.

In such circumstances the girl has prayed that the case be transferred to another district before a lady judge and a lady public prosecutor be appointed for the case. After hearing the case the court has issued notices to the accused and the state government to file their reply while the girl is allowed to amend the petition to join the legal department as a part in the case.
