Almost 23 days after disciplinary action was initiated against Major Nitin Leetul Gogoi of 53 Rashtriya Riffles for "fraternizing with local woman", the Army on Tuesday shifted the controversial officer from his parent unit and attached him to the divisional headquarters.

Sources said Major Gogoi, who first sparked a major controversy for using 26-year-old youth Farooq Ahmad Dar as a "human shield" to negotiate stone pelting mobs last year, was shifted from his unit at Beerwa in Central Kashmir's Budgam district and attached to the Awantipora-based Victor Force headquarters of the Indian army.

Then on August 27, the Army's Court of inquiry (CoI) —led by a Brigadier rank officer — ordered initiation of disciplinary action against Major Gogoi after he was found guilty for "fraternising with locals in spite of instructions to the contrary and being away from the place of duty while in operational area".

Five days later on September 1, Chief Judicial Magistrate (CJM) Srinagar Aijaz Ahmad Khan ordered a re-investigation into the hotel fracas case. The court also directed the police to probe the role of Sameer Ahmad Malla, the aide of Major Gogoi, who had ferried the army officer and a woman to a hotel in his private car.

The case dates back to May 23 when Major Gogoi was caught with a young woman while trying to check-in a local hotel in Srinagar. Major Gogoi was later detained by the police along with a young woman and accomplice Sameer Malla after the hotel authorities reported the matter to the cops. Police later handed him over to his unit after questioning. The woman was handed over to her relations.

Chairman of the International Forum for Justice Human Rights Jammu and Kashmir Muhammad Ahsan Untoo, who had approached the Chief Judicial Magistrate Srinagar praying for action against Major Gogoi and Sameer Malla, said army is trying to save its image by shifting him out.

"Why was not action taken against him when he used Farooq Dar as human shield? Instead he was awarded for that. Plus the police is trying to pass the buck despite the directions from the court", he said
