Yeddyurappa's petition for quashing Lok Ayukta report posted to Aug 29

The Karnataka High Court Thursday posted to August 29 for orders the writ petition filed by former chief minister BS Yeddyurappa, praying for quashing of a portion of the Lok Ayukta report which indicted him in connection with illegal mining.

Justices KL Manjunath and HS Kempanna posted the petition to that date after hearing Supreme Court advocate Ram Jethmalani, who is appearing for Yeddyurappa.

Yeddyurappa has prayed for quashing Chapter 22, which refers to "certain payments (of Rs30 crore) made by private mining firm South West Mining Company Limited to Prerana Education Society, a trust of which his sons, BY Raghavendra and BY Vijayendra are trustees and certain sales effected by his son and son-in-law, of an acre in suburb of Bangalore to South West Mining Company Limited is abnormal."

Jethmalani said the allegations were without any credible evidence and perverse without calling for any explanation. Yeddurappa's sons should have been given an opportunity to explain, instead of just going by the report filed by the enquiry officer UV Singh, he said.

"Where does corruption come in the donations, Rs10 crore given to an educational trust and Rs20 crore for building an auditorium," he asked.

Jethamalani pointed out that in the entire document "there is no mention about Yeddyurappa's name". He further submitted that former Karnataka Lokyukta Santosh Hegde had "been misled" by the enquiry officer.

He further stated that mining lease granted to South West Mining Company Limited was in 2007 "when Yeddyurappa was not the chief minister. It was somebody else who was the chief minister at that time".

There is no favouritism that has been shown to the said mining firm, Jethmalani submitted.

Terming the indictment as "most irresponsible action", he contended that former chief minister "deserved to be protected and heard".

The court then posted the petition to August 29 for orders.
