Metro Bankers’ Enclave apartments demolition stayed

About 45 families residing at Metro Bankers’ Enclave apartments located in GM Palya can now heave a sigh of relief as the Karnataka high court has granted a stay on the demolition proceedings launched by the BBMP against the residential complex.

A division bench of Chief Justice JS Khehar and Justice AS Bopanna stayed the demolition proceedings in an appeal filed by the Metro Bankers’ Enclave and observed that the appellants had the right to appeal against the BBMP move.

The residents of Metro Bankers’ Enclave had gone in appeal before the division bench, after a single-judge bench declined to stay the severing of electricity and water supply connections to their homes as the five-storey structure did not have occupancy certificate from the BBMP.

The judge had on February 17 directed the BBMP to file a memo enclosing particulars of the personnel working in the engineering and revenue section, the local corporator and administration officers who were in charge of the ward number 58 (old 83) where the petitioners’ residential complex had come up, from 1996 till date. The BBMP had submitted to the high court that orders had been passed under Section 462 of KMC Act on February 15 to demolish illegal structures and action would be initiated in this regard.
