The principal secretary to the home department, SM Jaamdar, in an affidavit filed on Friday in the high court, said that police officials found guilty of  not executing warrants issued against former tourism minister G Janardhana Reddy would be placed under suspension. Reddy has since been indicted by the Lokayukta in illegal mining of iron ore in Bellary.

Jaamdar also said that a departmental inquiry would be instituted against police officials who failed to execute the warrants. It may be recalled that city-based advocate GR Mohan had filed   public interest litigation (PIL) in the high court alleging that Reddy was issued non-bailable warrant by the Judicial Magistrate First Class (JMFC) court. However, he had not presented himself before the court.

The advocate contended that the minister had evaded appearance before the JMFC court on several occasions, and consequently, the court issued a non-bailable arrest warrant. Each warrant was returned by the police. Even though the man was a minister and available at Bangalore or Bellary, the warrants were returned for the reason that the accused was not available.

In an earlier hearing, the high court had directed the principal secretary, home department, to file a statement on the non-execution of non-bailable warrants.

The report submitted to the court by the principal secretary admitted that “This is a typical and a serious case of collective failure of police from top to bottom level in executing the warrants issued by a criminal court. Each police officer has tried to pass on the buck to another simply because they were obviously aware and afraid of the consequences of the law against a powerful minister in the state cabinet.”

The report stated that the officers ignored judicial proceedings and put the onus of executing the warrants on  helpless constables. Constables questioned by the bureaucrat admitted that they received little help from senior police officers in executing the warrants, and were forced to file reports of the accused not being available. 

Among the officials named in the report are deputy superintendent of police (Kudligi), HY Turai, superintendent of police, Bellary,  MN Nagraj and DG and IGP Ajay Kumar Singh, who has since retired.
