The judgement by Empowered Apex Committee (EAC) of Gujarat Chamber of Commerce and Industry (GCCI) to cancel the selection for Business Women Committee (BWC) has led to exchange of words between the warring parties. Former GCCI president Shailesh Patwari said the EAC's decision is arbitrary. On the other hand, Ruzan Khambatta, a member of GCCI said that EAC has upheld the Constitution of GCCI and that women are being forced to withdraw their candidature during elections.
Khambatta had challenged the manner in which GCCI had amended the Constitution to remove the provision of election for BWC and instead nominate chairperson and members.
As per the Constitution of GCCI, a gap of 10 days is needed between the notice for amendment and the actual amendment, which was not maintained.
She said that not allowing elections makes businesswomen prone to manipulations to the powers-that-be in GCCI.
Former GCCI president Shailesh Patwari said that shortfall of days in maintaining the gap of days has been condoned during Annual General Meeting (AGM) and that EAC is not above AGM. "EAC decision to dissolve BWC and order new elections as arbitrary. EAC never gave me an opportunity to present his case.
Can look into breach of Constitution: EAC
"As per the constitution of GCCI, (it is) EAC's responsibility is to look into any breach of the constitution and give directions to the office bearers correct it.
"The directions given has nothing against the AGM, the office bearers of GCCI or any of the BWW members. No one is disqualified and the present incumbents are free to contest the free elections," said Chintan Parikh, member of Empowered Apex Committee (EAC).
