Ensure clean water, BMC tells builder

Brihanmumbai Municipal Corporation (BMC) has issued four notices to a developer to ensure that residents of a slum rehabilitation building in Worli are supplied clean hygienic water. A year ago, two pregnant women in the area died due to water contamination.

A division bench of chief justice Mohit Shah and justice DG Karnik was hearing a public interest litigation filed last year by Siddharth Khandagale and Rajnish Kamble following the deaths of the residents of the slum on E Moses Road in April 2010 due to water-borne diseases.

BMC counsel KK Singhvi submitted that notices have been issued to developer MY Lokhandwala following an inspection by the additional municipal commissioner (projects), deputy hydraulic engineer (city) and staff of the Water Works Department of G/south ward.

Developer’s advocate Cherag Balsara assured that the notices will be complied with. He added that water connection to the slum rehabilitation building will have to be discontinued for two days. “There may be some problem because of this. We require police protection,” said Balsara. BMC issued the notices following suggestion given by petitioners’ advocate Rakesh Agrawal stating that the level of the water storage tank needs to be raised due to the unhygienic surroundings and proximity to the drainage chamber.

An affidavit filed by Mukund Joshi, assistant engineer, (water works) said that four different notices have been sent to the developer. The developer has also been asked to repair the storage tank for transit camp which is damaged. The matter is adjourned to June 28.
