Rubabuddin's petition to be a party in Amit Shah bail plea hearing denied

A CBI special judge, GK Upadhyay, has rejected a plea moved by Rubabuddin Sheikh, brother of Sohrabuddin Sheikh, to join as a party respondent in the hearing of the bail plea of former minister Amit Shah.

While delivering the verdict on Monday evening, the judge observed that, Rubabuddin cannot directly join as party in the case. He has liberty to submit evidence or documents related to the case to the Central Bureau of Investigation (CBI) which in turn can apprise the court about Rubabuddin's submissions. Earlier, a lawyer on behalf of Shah, submitted that, Rubabuddin is not a victim in the case and hence cannot joint as a respondent while hearing the bail application.

Rubabuddin submitted in his application that, Shah should not be given bail as he is likely to tamper with evidence and hamper investigation which is in a crucial stage. It is pertinent to note that, Amit Shah, who was arrested last month, has filed for bail application before the CBI court and it is scheduled to be heard on September 7.

Hearing of Shah's bail plea  adjourned for third time
The special CBI court on Monday adjourned the hearing of the bail application of former Gujarat minister of state for home Amit Shah, till September 7. Shah is in judicial custody in connection with the Sohrabuddin Sheikh fake encounter case.

The special CBI judge GK Upadhyay adjourned the matter after Shah's council sought more time as their senior counsel, Ram Jethmalani, could not come for the hearing. This is the third time that the hearing in the matter had to be adjourned because of Jethmalani failure to turn up in court.

Shah was arrested by the central bureau of investigation (CBI) on July 25 on the charges of murder, extortion and kidnapping. His bail application was filed on July 26, a day after his arrest. The former minister has been interrogated twice by the CBI, first in the Sabaramati jail and then in the office of the CBI in Gandhinagar.
