Order on probe into Assemanand's confession leak tomorrow

A Delhi court today deferred for Thursday its order on a plea for registration of an FIR against a CBI officer and Tehelka magazine owner and editor for making public Swami Aseemanand's confessions to a court about his alleged role in the Ajmer blast case.

Additional chief metropolitan magistrate Sanjay Bansal, who was to pronounce the order today, deferred it as RSS activist Devender Gupta's counsel Anupam S Sharma wanted to make some additional argument on the plea.

Accordingly, the ACMM reserved the order on Gupta's plea after hearing Sharma's additional argument.

Referring to a series of rulings by the apex court and various high courts, Sharma argued the court has all the requisite powers to order a probe into the leakage of Aseemanand's confessions to a magisterial court under section 164 of the Criminal Procedure Code.

He sought the court's order pointing out that it was clear that an offence of a serious nature had been committed and no action on it has been taken till date.

Gupta had filed an application yesterday, pleading that the court need not order the probe under provisions of anti-corruption law but under simple penal provisions.

Gupta, arrested for his role in Ajmer dargah blast case, is currently lodged in the city's Central Jail.

Charge-sheeted by Rajasthan's Anti-Terrorist Squad for his alleged role in Ajmer blast case, Gupta had sought lodging of the FIR against CBI's additional superintendent of police TR Balaji and Tehelka magazine owner, publisher and editor Tarun Tejpal.
