Former Chief Minister N Dharam Singh sought for the withdrawal of a case filed by him in the high court seeking to quash an FIR in connection with an alleged illegal mining scam involving him.

It may be recalled a businessman, TJ Abraham, had alleged external affairs minister SM Krishna and former chief minister HD Kumaraswamy,

in addition to Singh, of being involved in illegal mining during their tenure as chief ministers and sought sanction for their prosecution by the speaker of the Lok Sabha as they are members of parliament.

The Lok Ayukta special court, on December 3, had directed Lok Ayukta police to investigate and submit a report in this regard on January 6.

The FIR was filed by the Lok Ayukta police against Kumaraswamy, Krishna and Dharam Singh on December 8.

In his petition, Singh had sought to quash the FIR registered against him. The counsel for Singh on Tuesday submitted before the court that Singh wants to withdraw the case in the wake of a PIL filed by D Natesh, an advocate.

Natesh had stated that the commissioner for mines and geology research and director for mines and geology on November 19, 2004, had withdrawn the permission granted to the Pattadars for lifting and transporting iron ore as they did not have a mining lease.

The high court on November 25, 2004, had quashed the withdrawal and remanded the matter for consideration afresh.

However, on July 2, 2005, the commissioner wrote to the government for the review of the decision in view of legal bar for the grant of permits on the ground that no permits can be granted to Pattadars in the absence of a mining lease and without the approval of the central government.

However, this objection was overruled by the Dharam Singh and permits were granted for lifting and transporting iron ore in huge quantities, contrary to the law resulting in the loss over Rs23 crore to the state exchequer. 

Natesh had sought appropriate action against Singh and stated the loss should be recovered. The PIL will come up for hearing on February 16.
