Karnataka Chief Minister HD Kumaraswamy on Tuesday lost the trust vote in the assembly, thus ending the 14-month rule of Congress-JDS coalition in the state. Kumaraswamy who had called for a trust vote after over a dozen Congress-JDS MLAs had rebelled, lost the confidence motion in the assembly by 99-105. 

Earlier, replying to the debate on the motion before the voting was held, Kumaraswamy said he was ready to "sacrifice" his post happily.

"I am ready to happily sacrifice this position," Kumaraswamy said after the assembly debated the confidence motion for four days.

He also said he had no intention to drag the trust vote and added, "I apologise to the Speaker and the people of the state." Kumaraswamy also said discussions were on why he had not resigned and was sticking to the chair.

He said when the 2018 assembly polls results were out, he had plans to quit politics.

"My political entry itself was all of a sudden and unexpected," he said.

The Speaker was represented in Court by Abhishek Manu Singhvi who said that Speaker has to manage the House and still there are MLAs remaining who have to speak on the trust vote motion.  He said Court is illegally sought to be drawn into the political matter. 

Senior lawyer Mukul Rohatgi appearing for two MLAs argued that Speaker has been changing statements. He sought an order from Court asking Speaker to hold trust vote today. Court recorded the submission of Singhvi,  refused to pass any order for today,  and posted the petition for hearing tomorrow.

* Rebel MLAs did not appear in person in front Speaker (Summon was sent to all to appear at 11 am on 23rd July before speaker ) the representation is being made by the lawyers on behalf of rebel MLAs. Speaker is listening to the lawyer. Congress leader of House Siddaramiah is also present in the chamber.

Shivakumar warns BJP: 

 It's not BJP leaders who have backstabbed me but it's the rebels in Mumbai who have backstabbed me. But, do not worry, they will do the same to all of you. They cannot become Ministers I'm telling you.
BJP leaders are being misguided. I went to Mumbai to speak to them. I spoke to one of the MLAs there and he asked me to come and take him away. 

* Lawyers on behalf of rebel MLAs leave the speaker's chambers. The rebel MLAs sent their lawyers stating a need for 4 more weeks before appearing before the speaker. A delegation from the Congress party also met the speaker and said immediate action needs to be taken and four weeks is too long a time.  The Congress argued that this is a situation where the anti-defection law applies.

The Congress-JDS government in Karnataka collapsed on Tuesday after it lost the vote of confidence in the Assembly, ending the nearly three-week-long high political drama in the state.

With the numbers stacked against him, Chief Minister HD Kumaraswamy faced the defeat after winding up the debate for four days on the motion of confidence moved by him on Thursday last, amid the political turmoil.

Speaker KR Ramesh Kumar announced that 99 MLAs had voted in favour of the motion and 105 against it. The motion had been defeated, he said.

The Congress-JDS government had defied the two deadlines set by Governor Vajubhai Vala to Kumaraswamy to demonstrate his majority on Friday itself.

A wave of resignations had set off the political turbulence in the state, pushing the 14-month old coalition government to the brink of collapse. 

Earlier, before the voting, Kumaraswamy replied to the deabte on the motion of confidence.

I'm from a village. As a youth I have been with the Congress party. Rajiv Gandhi recognized me and gave me a ticket. I didn't win but I became the zilla Panchayat leader.

 I've come from a village and I came through the student politics. I've been an MLA from 1989. I've seen many debates. The politics before was respected. But now, we're shown in a bad fame. I've been in the opposition's seat as well as a minister.

Yeddyurappa said long ago that those who are responsible for by elections should be barred from contesting for 10 years. He argued that there should be a law to this effect. Narendra Modi has got a mandate and we have no problem with that. But you are the leader of this party. Come on! This is the time, put a stop to this. Let us bring an end to this!

 We've seen many changes of chief ministers, it's a power game. But power struggle is different. Look at our friend AH Vishwanath, who calls me a showman. He has written a book in which he asks what a person should be called who changes his house? They are only looking for greener pastures.

I appreciate Yeddyurappa's perseverance. He failed six times and now he looks close to succeeding. But I don't know how those rebels will become ministers.
I'm not an educated person, that's because I graduated only at the age of 48 because my children questioned me. I got into politics and didn't complete college.
All these leaders MTB Nagaraj, ST Somashekhar, Munirathna worked so hard even in Lok Sabha. They told me that they would follow me out, when i gave a dinner for the MLAs. I told them that the people would not forgive me.

I saw on TV that there were 10 MLAs in the speaker's chamber and I went there and tore their resignations, I won't deny that.

Those MLAs in Mumbai are not disgruntled, they're happy. We know that Mumbai is very hospitable. The matter of the whip applies to all political parties. In the X Schedule it says that those who are disqualified in an Assembly cannot also become a minister.

I asked them, even last night when I spoke to them, why they left and they told me that they'll come back to us after becoming a minister in the BJP government. I told them that they're being fooling you and that they're being killed politically.

The chief minister has moved a confidence motion. You've said that discussions should end at 4 pm and after that chief minister will speak. I'll try and finish before then but in case I exceed the limit I ask you to allow me some leeway


The coalition government has been in existence for 14 months. The people didn't give majority to any single party in the assembly elections last year, it was a fractured verdict. In democracy the verdict of the people must be respected by all parties.


Through their verdict, the people gave Congress 80 seats, BJP 104, JD(S) and BSP 38, KPJP 1 and one independent. So no party reached the 113 threshold for majority. However, in terms of vote share we got 38.14%, BJP 36.34% and JD(S) 18%. I'm talking about this because no party had a majority. Our high command decided after the results to join hands with JD(S), and Kumaraswamy became the chief minister. Our combined vote shares were 56.44%. This is the people's mandate.


When this was the case, the Governor called Yeddyurappa to stake a claim as the single largest party even though we had claimed to form government as a coalition. We should've been called, it wasn't necessary to call Yeddyurappa.

Even though he was given 15 days to prove majority. This is generally not done in a hung house. This is why SC reduced the time given to 24 hours. He couldn't prove majority, he had to step down. Now Yeddyurappa says that we have lost majority. I'm tired of hearing this. Horse trading began as soon as the BJP was given 15 days to prove majority last year.

We must remember history. People haven't sent us voluntarily, we've come here because we want to do social service. It is also not a profession. But in politics there are ideology and party ideals, if we don't understand this then there's no point in public life.


Franchise was limited to the rich before independence. We got this only through the Constitution.
We must believe in this constitution because it doesn't differentiate.

Parliament, judiciary and executive are the pillars of democracy. No authority is above the Constitution, it's very clear.
So, Yeddyurappa was given an opportunity but he couldn't succeed. You couldn't prove majority. It was only after that that Kumaraswamy was called to form the government. He became chief minister based on constitution and laws. This is not the first coalition in the country, there have been coalitions at the Centre, other states and even here.

There have been 4 coalitions in the state. First in 83, then 04, 06 and now this. In fact in 2008, when Yeddyurappa became cm, even then they didn't have majority, they won only 110 seats and formed government with support of 6 Independents.
Last year only one independent won. I feel that Yeddyurappa shouldn't even have tried to form the government. Without JD(S) or Congress MLAs defecting how could you form government. It clearly indicates that you made up your mind to engineer defections last year

How would it have been possible for you to give a stable government? Impossible! So from that very moment they began defections. Fortunately, if the SC hadn't reduced the time granted the murder that has happened today would've happened then.

What happened in Goa, since you say single largest party was called? We must express the pain of these anti democratic tendencies.

We've agreed to democracy. The roots of democracy are strongest in India. The biggest crime will be trying to uproot this. We must instead try and strengthen it further. We must not try and uproot it for greed.


You should've been a strong opposition with 104 MLAs. You could've held the government accountable. But you insisted on such dubious measures.
This resignation drama was changed with the 35th constitutional amendment. After this the Speaker got discretion because many were coerced, lured into resigning.


The clause voluntary and genuine was added. In the Ravi Nayak case a differentiation was made between resignation and voluntary resignation. This is why the when the 15 MLAs positioned the SC it did not fetter the Speaker. The speaker also has the right to disqualify, nobody can meddle in this. No court has jurisdiction till the Speaker decides. This is why I raised a point of order. It said no member can be compelled to attend the house. That's why I raised the point of order. What happened to X Schedule? It is still in existence, no amendment has happened in parliament. It is enforceable. You (speaker) have rightfully taken the decision that we can issue the whip.


There are two Grounds for disqualification, voluntary resignation of party membership. In the TN case they didn't violate whip, but they gave governor a letter withdrawing support. But the Speaker said by their conduct their relinquishing membership of their party. There was no whip there, the MLAs hadn't even resigned as MLAs. Their conduct led to their disqualification.


The other ground is if they vote violating the whip his political party.
According to me both apply to the rebels. You've said i have the right to issue whip and for this you have my thanks.

As many as 16 MLAs -- 13 from the Congress and three from JDS-- had resigned, while independent MLAs R Shankar and H Nagesh withdrew their support to the coalition government, pushing the government to the precipice.

One Congress member Ramalinga Reddy retracted from his decision to resign, saying he would support the government.
The ruling combine's strength is 117-- Congress 78, JD(S) 37, BSP 1, and nominated 1, besides the Speaker.

With the support of the two independents, BJP has 107 MLAs in the 225-member House, including the nominated MLA and Speaker.
If the resignations of 15 MLAs (12 from Congress and three from JDS) are accepted or if they stay away, the ruling coalition's tally will plummet to 101, reducing the government to a minority.
