Ordinance on salary hike for CJI, SC, HC judges sent to Prez

The Law Ministry has sent to president Pratibha Patil an ordinance proposing over three-fold hike in the salaries of the chief justice of India and judges of the Supreme Court and high courts.

A nod from the president would mean a revised salary of Rs 1 lakh for the chief justice of India, Rs 90,000 for Supreme Court judges and high court chief justices and Rs 80,000 for HC judges.

"The matter is now with the president...the Ordinance has been sent to her," said a law ministry officer on Monday.

The proposed hike in salaries would also mean a substantial increase in pension for judges, who are entitled to 50 per cent of their last drawn salary as monthly pension.

Law minister HR Bhardwaj, had last month, introduced the high court and Supreme Court judges (Salaries and Conditions of Service) Bill in the Lok Sabha but it got stuck in one House of Parliament. The government later cleared an ordinance to hike the judges' salaries.

Bhardwaj introduced the Bill amid a din by BJP members protesting minority affairs minister AR Antulay's controversial remarks on the killing of Maharashtra ATS chief Hemant Karkare during the Mumbai terror attacks.

The Ordinance proposes to hike the salary of the CJI from Rs 33,000 per month to Rs 1 lakh per month, and that of other apex court judges from Rs 30,000 per month to Rs 90,000 per month.

It seeks to increase the salary of the chief justice of high courts from Rs 30,000 to Rs 90,000 per month and that of the judges of high courts from Rs 26,000 per month to Rs 80,000 per month.

Based on the recommendation of the Sixth Pay Commission, the Central Government has decided to grant additional quantum of pension and family pension with reference to the age of the Central Government pensioner and family pensioner.

Similarly, it has been decided to extend similar benefits to all retired judges, Bhardwaj said in statement of objects and reasons for the Bill.

The hike in the salaries is proposed to be effective from January 1, 2006. This salary hike would entail an additional expenditure of Rs 46 crore, of which Rs four crore would be recurring and the rest would be for paying arrears in salary,
pension and family pension.
