BSP MLA's bail plea in murder case rejected

FAIZABAD: A local court on Saturday turned down the bail application of BSP MLA Anand Sen in the murder case of a law college student, upholding the narco test report according to which he is allegedly involved in the crime.
    
Faizabad Additional District Judge (Special Judge SC/ST Act) Vimal Chand rejected the plea, citing that narco test report, which states that Sen "conspired" to kill Shashi Prasad, was taken as the base of the case.
    
Prasad was killed in November, 2007 and Sen, then the food processing minister in the Mayawati Government, was among the three accused. Sen, prime accused Vijay Singh and Seema Azad are lodged in the Faizabad district jail.
    
Public Prosecutor Avadhesh Yadav said though Supreme Court had ruled that narco test report can not be admissible in a court, the report was considered as an "important evidence and legal part of the case."
    
The court also observed that bail plea was rejected as the accused may tamper with evidence and influence witnesses. The MLA from Milikipur assembly segment is facing 12 criminal cases.
    
Avadhesh Yadav, counsel for Sen, said he would move high court for bail.
    
Sen's father Mitra Sen Yadav is Lok Sabha MP from Faizabad.
