J&K (Reorganisation) Bill 2019: How parties voted to bifurcate state

The Jammu & Kashmir (Reorganisation) Bill, 2019, which strips Jammu and Kashmir's status of a state and converts it into a Union Territory with legislature and carving out Ladakh region as a UT without legislature, was passed in a division pressed by the opposition with 125 votes in favour and 61 against, and an NCP member abstained. 

Several non-NDA, non-UPA parties supported the government's resolution in Rajya Sabha to abrogate Article 370 which gives special status to Jammu and Kashmir (J&K).

The resolution to do away with the provision was introduced by Home Minister Amit Shah in Rajya Sabha earlier in the day.

Shortly after the introduction of the resolution, President Ram Nath Kovind came out with a notification — The Constitution (Application to Jammu and Kashmir) Order, 2019 that will come into force immediately. The order will supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 as amended from time to time.

Later, the Constitution (application to Jammu and Kashmir) Order, 2019, which scrapped Article 370 was taken up in Lok Sabha.

The reorganisation bill was passed with support from several opposition parties, which, surprisingly, included AAP, BSP and TDP. Members of BJD, AIADMK, and YSR Congress also supported it.

During the discussions on reorganisation bill in Rajya Sabha, BSP MP Satish Chandra Mishra said, "Our party gives complete support. We want that the Bill be passed. Our party is not expressing any opposition to Article 370 Bill and the other Bill."

BJD member Prasanna Acharya announced the party's decision to support the resolution in the House, putting the "nation first" and said Kashmir become an integral part of India in "real sense" after the abrogation. "In a real sense, Jammu & Kashmir has become a part of India today. My party supports this resolution. We are a regional party but for us, the nation is first," Acharya told Rajya Sabha.

Supporting the resolution, AIADMK's A Navaneethakrishnan cited late Jayalalitha to emphasize that she always wanted the special provision to go. "Amma (as Jayalalitha was popularly known) was well known for upholding sovereignty and integrity. So AIADMK party supports the two resolutions, Reorganisation Bill and the Reservation Bill," he told Rajya Sabha.

 

TDP chief N Chandrababu Naidu, whose party left the Modi government over special status to Andhra Pradesh, voiced his support for the scrapping of Article 370 on Twitter.

 

"Telugu Desam Party supports the Union Government as it seeks to repeal Article 370. I pray for the peace and prosperity of the people of Jammu and Kashmir," the former Andhra Pradesh chief minister tweeted.

 

AAP convenor and Delhi Chief Minister Arvind Kejriwal, who has been at loggerheads with the Centre, took to Twitter to announce his party's decision to support the government on the resolution.

 

Kejriwal said, "We support the government on its decisions on J&K. We hope this will bring peace and development in the state."

 

Andhra Pradesh Chief Minister Y S Jaganmohan Reddy-led YSRCP also supported the resolution in the House.

However, the Bill was met with stiff opposition from the main Opposition Congress, DMK, MDMK, RJD, SP, CPM, CPI, Muslim League, Kerala Congress, with DMK chief MK Stalin calling the move "murder of democracy".

Echoing similar sentiment, MDMK leader Vaiko said, "This is a day of shame, shame, shame...this is murder of democracy."

Also, NDA ally Janata Dal (United) did not support the Centre's decision to abolish Article 370.

During the voting on Jammu and Kashmir (Reorganisation) Bill 2019 in Rajya Sabha, three parties including TMC, JD(U) and NCP staged walk-out from the House while PDP members were marshaled out.

Rajya Sabha on Monday passed the Bill to convert Jammu and Kashmir into a union territory and to carve out Ladakh as another UT.

The Jammu and Kashmir (Reorganisation) Bill 2019 was passed with 125 in favour and 61 against in a division pressed by the Opposition after Home Minister Amit Shah assured the House that Jammu and Kashmir state status will be restored once the situation normalises.

 

Replying during the debate on the Bill, Home Minister Amit Shah said Article 370 was the biggest hurdle in normalising the affairs in the border state and vote bank politics was the main reason for the provision survive all these while.

 

He appealed to the members to rise above vote bank politics and support the measure. Shah said Article 370 was also the main reason for terrorism to have sustained for long and said the menace would soon be eliminated.

 

He also told the House that in five years time Jammu and Kashmir would be the most developed entity in the country.
