By taking a complete U-turn, Vasundhara Raje Government reverses its all penal discussions against a mega reality project “Pallacia” near statue circle in the state capital. It is being considered as a major setback to the credibility of the state govt which had gone out of the way to punish the project for its “undue favours” received during the Gehlot Govt. The real tragedy is that the former Chief Secy Rajiv Mehrishi had initiated disciplinary proceedings against the former ACS UDH GS Sandhu in the same case for his supervisory negligence and now the state govt, by cancelling its penal orders against the project, has virtually restored Sandhu’s order. One senior bureaucrat remarked on this development by saying that “in an election year, state govts often have to act under political pressure in the name of public interest”.

On December 3, 2014, the BJP government had issued a notification and an order against the ‘Pallacia’ project whose promoter is Om Metals. In the notification, the UDH department in order to reduce the height of this project restricted height of buildings on the plot on which ‘Pallacia’ project is situated as well as adjoining type ‘A’ plots to 15 meters, which was earlier 30 meters.

Further, on the same day in an order it withdrew all exemptions and concessions given by Gehlot government. Now, reversing its earlier position, the BJP government has revoked previous notification and the order. Moreover, the Raje government in apparent benevolent mood also decided not to file appeal in division bench of the high court against JDA appellate tribunal’s order regarding cancellation of the project’s building plan.

With this, all hurdles in way of this project have been cleared. Now, the project can commence as per then ACS (UDH) GS Sandhu’s order with all exemptions, concessions and building plan approved by the then Gehlot government.

What order means

Project can be built up to 30 mt.
Concessions and exemptions given by Gehlot govt reinstated.
The project had received exemptions from violation in set back norms, without permission house construction for poor and not submitting proposal on time.
In accordance to JDA appellate tribunal decision the JDA will revoke order of cancelling project’s building plan.  
JDA will not file appeal in the HC against JDA appellate Tribunal’s decision.

The time line

The matter reached SC against notification & order of Dec 3, ’14.
The Supreme Court asked the state government to take an equitable decision.
Following the SC order the JDA cancelled building plan.
Om Metals filed appeal against this order in the JDA appellate tribunal.
The tribunal ordered in its favour restoring building’s height to 30 meters.
The JDA filed appeal against this order in the high court.
The single bench of the HC upheld JDA tribunal’s decision.
JDA was planning to file appeal in the division bench against it.
