A Delhi court on Monday acquitted a man accused of rape, stating that the physical relationship between the accused and the complainant was consensual. The court observed that the woman’s intimate relationship with the man showed that “her relationship was not an act induced by misconception of any fact”.
Additional Sessions Judge Gautam Manan set free the south Delhi resident on charges of raping the 32-year-old woman and said that seeing the age of the woman, it can be easily inferred that she knew about the consequences of allowing a male friend in her bedroom at night. “The entire circumstances discussed above and that have come to the fore from the testimony of none else but the prosecutrix, it cannot be said that the sexual intercourse was without her consent. The act seems to be consensual in nature,” the court said.
