Kingfisher Airline has found itself back in the Bombay High Court after German maintenance, repair and operations (MRO) company Lufthansa Technik filed a petition against the airline.

Lawyers of both the parties did not wish to discuss the case or the reason for the petition filed. However, sources close to the case said it is about pending payment of Rs 3 crore.

Sources said the MRO company has asked Kingfisher to pay them Rs 3 crore for the components and return the components used by them, the value of which is still unknown.
Sources said this dispute started after Kingfisher’s takeover of the low-cost carrier Air Deccan, when the airline company was negotiating its contract with Lufthansa, as it had two separate contracts for the carriers.

On Friday, the Bombay High Court asked the counsels of both parties to move the vacation bench to hear the case. A date for the hearing was not furnished.

This is the second case that has been filed against the airline by Lufthansa Technik. The first case has been filed in the Delhi High Court for non-payment of Rs 17.7 crore for the months of July, August and September 2009 despite enjoying technical support.

It is also the second case against the airline filed in the Bombay HC.

Bharat Petroleum had filed a case against Kingfisher for non-payment of dues, which ran to Rs 314 crore. On Thursday, the court adjourned that case till November 3.
