According to the national sports development code of India, 2011, the president of IOA cannot hold the position for more than 12 years, but Suresh Kalmadi has been holding the post for around 18 years.
In a huge setback to Suresh Kalmadi, the Delhi high court (HC) on Thursday directed the Indian Olympic Association (IOA) to follow the sports code of the government of India for its next elections, scheduled for October or November this year, and said he was ineligible to be its president.
According to the national sports development code of India, 2011, the president of IOA cannot hold the position for more than 12 years, but Suresh Kalmadi has been holding the post for around 18 years.
A division bench of acting chief justice AK Sikri and justice Rajiv Sahai Endlaw said that elections of the IOA this year must be conducted as per the sports code of the government. Under the code, the president, secretary and treasurer of any recognised national sports federation, including the IOA, shall cease to hold the post on attaining the age of 70 years.
The code also lays down that the secretary and the treasurer may serve a maximum of two successive terms of four years each. The court, which was hearing a batch of applications filed by lawyer Rahul Mehra on the issue, has now fixed the matter for hearing on October 15.
During the hearing, Mehra submitted that the elections for various posts of the IOA is likely to be held in October this year and there was every likelihood that sports administrators like Kalmadi may flout the national sports development code to get re-elected.
On Mehra’s another plea that the election of Athletics Federation of India was not held on April 14 this year as per the sports ministry guidelines, the court asked the ministry to take a “reasoned” decision within six weeks after considering the submissions of the lawyer and the sports body on the issue.
The high court also clarified that punitive measures like de-recognition of the sports body may also be taken if the allegations of flouting of guidelines is found to be correct.
The court, meanwhile, decided to hear on Friday another of Mehra’s pleas for a direction to hold the elections of the archery federation’s office bearers as per the sports ministry guidelines.
