Techie moves court over FB post granting fake No objection certificates

Pune: A resident of Pashan Sus Road area, who recently purchased a flat in Bangalore has moved the court against another flat owner of the same complex for allegedly using Facebook for fraudulent activities. The complainant has mentioned that the builder is not providing a No Objection Certificate (NOC) for the transfer of electricity metres after which residents started a campaign on Facebook, in which the flat owner asked other flat owners to pay him and he would allegedly give them a fake NOC.

Taking cognisance of his complaint, the court of Judicial magistrate (First Class) Kranti Pingale has issued process against the said member.
Gurupritsingh Hardayal Singh Johal (36) is a software engineer and a resident of Kumar Papillon on Pashan Sus Road. He has also bought a flat in Bangalore where another person named Sathiya Srinivasan also bought a flat. Johal has moved a private petition before the magistrate Pingale by his lawyer Sudip Kenjalkar against Srinivasan under the relevant section of The Information Technology Act section 66A comprising punishment for sending offensive message through communication services etc and also under the Indian Penal Code comprising forgery, punishment for abetment. Johal in his plaint alleges, “I had booked a flat in Banglore last year. Despite the society was formed, the electricity bills and the meters were in the name of the builder. Despite repeated requests from the flat owners the builder was not transferring the electricity meters in the name of flat owners nor he was giving NOC to them. All the members of the society created a group on social networking sites including Facebook ‘Manhar Manha’.”
“Srinivasan posted the comment that for collecting NOC from builder one has to do settlement with him and if not pay Rs 50 extra to him and he will prepared forged NOC.”
