Supreme Court extends stay on construction ban in Mumbai

Now, the BMC can give permission to construction proposals till October 23, given that they have proper debris management system

Bringing relief to builders and developers, the Supreme Court on Tuesday extended stay on construction ban in the city for a month. Now, the Brihanmumbai Municipal Corporation (BMC) can give permission to proposals submitted by builders till October 23, given that they have proper debris management system.

The Supreme Court, on March 15, lifted its ban on construction activities for six months and directed the BMC to implement new debris management scheme within this period. The deadline ended on September 15. BMC officers filed a detailed report regarding the number of permissions issued in the last six months, the amount of debris generated and sites inspected under SC's direction and the action taken against errant builders. On Tuesday the Supreme Court extended the deadline for a month allowing the civic body to give permission for new constructions till October 23, said Vishwas Shankarwar, BMC deputy municipal commissioner in charge of solid waste management.

In March 2016, the Bombay High Court had imposed a ban on all new constructions, except redevelopment and slum rehabilitation schemes, since the city's landfills were saturated owing to lack of proper waste management system. Following the ban, Maharashtra Chamber of Housing Industry (MCHI) approached the Supreme Court for relief. On March 16, the Supreme Court granted a conditional relief for six months and directed the BMC to submit a report on debris management.

Under the Supreme Court's direction, the BMC started approving building proposal from March itself. Till September 15, the BMC cleared 1293 building proposals, mostly in western suburbs. 634 new building proposals were sanctioned in Western suburbs, 264 in eastern suburb and 384 in south Mumbai. The civic body had approved 94 per cent of proposals in the first four months. 1216 proposals got approval by July 15. After that, the number of proposals came down due to delay in implementation of new DCR.
