According to the prosecution, the actor did not have a licence when he was said to be driving the day the accident happened.

The court rejected the application on the ground that it was not maintainable at the current stage. It added that it had been the defence's case that the accused was in possession of a licence at the relevant time, the prosecution the could have called for it during the trial.

The defence had opposed the application, saying under the Code of Criminal Procedure, an accused does not need to produce any evidence against himself and that he can't incriminate himself.
