Advocate Nagesh Mishra, who appeared on behalf of the singer, said, "We had filed for bail on May 13 on the grounds that the prosecution had collected enough evidence against the accused. We had also ensured the court that we would fully co-operate with the investigation, whenever the police would ask us to."

The bail application filed by the accused maintained that it is highly impossible to recover the clothes which the singer was wearing since the incident is almost a year old. Similar is the case with medical examination; and thus, keeping the accused beyond bars wouldn't make any sense.
