The Shiv Sainiks have filed the petition after the police refused to grant them permission to hold the rally. However, they had failed to maintain to the decibel level in silence zone as a result of which, an FIR was lodged by the police against two office bearers of Sena.

On May 5, 2010, the high court had directed the Maharashtra government to initiate steps to declare Shivaji Park as silence zone when a PIL was filed by a NGO, Wecom Trust. The court had exempted three days in a year from the silence zone purview - Maharashtra Day, Republic Day and Ambedkar Jayanti.
