A former income-tax commissioner was convicted on Thursday by a special Central Bureau of Investigation (CBI) court in a graft case, and sentenced to four years of rigorous imprisonment.

Dayashankar, who was arrested in 2011 for taking a bribe of Rs 2 lakh from a Daman-based businessman, was also slapped with a fine of Rs 2.5 lakh.

Dayashankar was caught red-handed in his office at Bandra-Kurla Complex, after which the businessman, who deals in copper-wire manufacturing, approached the CBI to lodge a complaint.

According to the CBI sleuths, the businessman's firm had filed I-T returns for the assessment year 2008-09. The returns were taken up for scrutiny by the jurisdictional income tax officer (ITO), who passed an order for additional tax liabilities.

The ITO had raised an I-T demand of Rs 1.41 crore against the businessman, which was not due from him.

After failing to convince the ITO, the businessman approached Dayashankar, who asked for a bribe to settle the matter.

He initially demanded Rs 25 lakh to get a favourable assessment order, but agreed to do it for Rs 2 lakh later.
